TERMS AND CONDITIONS OF PARTICIPATION IN THE “FLIGHT SIMULATOR #1 – ASAA D. O. O. 2023” PRIZE GAME
The organizer of the prize competition “FLIGHT SIMULATOR – ASAA D. O. O. 2023” (hereinafter referred to as “the prize competition”) is ASAA, computer science d. o. o. , VAT ID SI 95144285 (hereinafter referred to as “ASAA d. o. o. ” or “the organizer”).
2. Purpose of the Prize Contest
The purpose of the competition is to promote the Flight Simulator #1 brand and gain as many followers as possible for the organizer of the competition on social networks Instagram (flyone. si), Facebook (Flight Simulator #1 - Opening in Ljubljana) and TikTok (flyone. si). In the following, Instagram, Facebook and TikTok of ASAA d. o. o. are referred to as “social networks”.
3. Duration of the Prize Contest
On 25 May 2018, the new General Data Protection Regulation came into force, which provides individuals with more control over their personal data. To this end, ASAA d. o. o. has established a new way of participating in prize contests, which we organize on social networks. The procedure is as follows. At each competition, we will inform you about the purpose and scope of the collection of personal data.
An individual who would like to participate in the competition via social networks and agrees with the purpose and scope of the collection of personal data, when responding creatively to the competition, in the comments indicate the persons with whom he would like to test the flight simulator, i. e. express his consent in an unambiguous manner and follow all instructions of the organizer. In this way, he/she expresses his/her consent to the purpose and scope of the processing of personal data and participates in the prize competition. Comments that do not follow all the instructions of the organizer or comments from which it will not be possible to unequivocally understand consent will not participate in the selection in the prize competition.
An individual who does not wish to participate in the competition and only wishes to submit a comment shall clearly state in the comment that he/she does not agree to the processing of personal data and does not identify the persons with whom he/she would like to test the flight simulator.
5. Cancellation of participation in the competition
Participants can cancel their participation and their consent at any time until the end of the competition by sending a request with the note “CANCELLATION” to the e-mail address flights. ljubljana@gmail. com until 24. 12. 2023 at 23:59 hours. In this case, the participant shall be excluded from further participation in the competition and the organizer shall immediately ensure the deletion of his/her personal data.
6. Course of the prize competition
The participant participates in the prize competition in a way that, in accordance with these rules, in accordance with the requirements of publishing the prize competition on social networks ASAA d. o. o. (Flight Simulator 1#), performs the required task and gives his/her consent by which he/she accepts these General Terms and Conditions.
The participant can participate twice, namely:
By liking one of the Flight Simulator 1# social networks (Facebook, Instagram or TikTok) and adding a comment as described in point 4 of this document.
By sharing the organizer’s announcement about the prize game in their own story and marking the organizer’s profile on the social network through which the participant shared the story (Facebook, Instagram or TikTok).
7. Selection of the winners
On 25 December 2023, the Organizer’s Committee will select one winner from among those participants who will participate in the competition in accordance with these rules after the end of the prize competition at its own discretion.
The three-member committee will select the winners electronically. The selection will be publicly announced on social networks (profile name of the winner or surname and first name of the winner).
The minutes of the winners with their personal data will be signed by all members of the committee and printed in one copy and will be kept at the headquarters of the organizer for one year from the date of the record.
8. Prizes
The organizer will award one prize in the competition:

9. Notification and acceptance of prizes
The winner will be informed of the selection no later than three (3) working days after the end of the prize competition by publishing the organizer on social networks. The winner who participated only through social networks will be asked to send a message with his/her address to flights. ljubljana@gmail. com in a private message via social networks.
If the winner does not respond to the organizer within ten (10) working days of the announcement of the winners, he/she will be deemed to withdraw his/her participation in the competition and at the same time waive his/her right to the prize. Upon receipt of the information referred to in paragraph 1 of this Article, the organizer will inform the winner of the method of receiving the prize. The organizer does not assume any costs incurred by accepting the prize.
The Winner expressly authorizes the publication of their name and surname on the social networks of the Contest Organizer.
10. Taxation of prizes
Participants in the prize draw are informed about the possibility of winning prizes that are subject to taxation under the Income Tax Act. In accordance with the foregoing, they agree that in the event of being drawn as a winner in this prize draw, they will, subject to Clause 2. Article 35 of ZDavP-2 provide the payer of the prize (the organizer of the prize draw) with the following information: name and surname, permanent address
residence, tax number, tax office, no later than within five (5) working days from the announcement of the winners. If the winner does not provide this information to the organizer in the required

11. Protection of personal data

By participating in the Contest, the Contest Participant authorizes the Organizer, as the administrator of the personal data database, to collect and process their personal data for the purposes of:
The participant has the right to request rectification, deletion of personal data or restriction of processing. The participant may object to the processing of personal data, and the right to data portability is also recognized. With regard to the processing of personal data, the participant has the right to lodge a complaint with the supervisory authority in the event of a suspected violation of the rights of the participant or in the event of a suspected violation of the provisions of the EU General Data Protection Regulation and the Personal Data Protection Act.

12. Liability
Participants participate in the competition at their own risk. The organizers and persons participating in the prize competition are not liable for any damage resulting from the prizes. The organizer assumes no responsibility for any undesirable consequences that may be caused by
the Entrant and/or any third party suffered as a result of participating in the Contest or as a result of using the Prize.
The Organizer is also not liable if the server is unavailable, unless this can be attributed to grossly negligent or intentional acts, which the Organizer is obliged to represent. In addition, the organizer is not responsible for any technical faults and disturbances beyond its control (such as network or power outages). The organizer is in an emergency case of early termination of the prize competition.
for reasons beyond its control (e. g. force majeure), reserves the right to award prizes to those who participated in the Contest up to the moment of discontinuation or not to complete, cancel or terminate the Contest without any obligation to the participants. They should inform participants about this through social networks and, if necessary, through other means. In this case, the participants are not liable for the resulting damage. The decision of the Promoter on all issues related to the Contest or the application of the Rules is final and applies to all Entrants.
13. Exclusion from the Prize Contest
In case of violation of the above rules of the competition and other offensive comments and actions, the organizer reserves the right to exclude violators from the competition without prior warning.
14. Dispute Resolution
All complaints regarding the prize competition shall be resolved by the organizer. The organizer undertakes to eliminate justified complaints as soon as possible and to inform the complainant thereof. For all possible disputes in connection with this prize competition that cannot be resolved amicably, the competent court in Ljubljana shall be the court in Ljubljana.
15. Final provisions
By giving their consent to participate in the prize competition, participants accept all the stated rules and general conditions of the prize competition, which are published via Facebook profile Flight Simulator #1 - Opening and Ljubljana social networks and on the official website of the organizer. The rules come into force on the day of the start of the prize competition. The organizer reserves the right to supplement and
changes to these rules and general terms and conditions and undertakes to publish any changes or additions in the terms and conditions published on the official website of the organizer in the biography on social networks.
